Every model, performer or other individual is visible in any depiction of explicit sexual activity presented on the website found at hotebonytube.com was a minimum of eighteen years old at the time of the creation of those depictions.

Exemption: Content Produced by Third Parties

The operator of hotebonytube.com is not the primary "producer" of any images or video recordings of explicit sexual or simulated sexual behavior that may be featured there. The activities of owners and operators of the website are limited to the transmission, storage, retrieval, hosting, or formatting of content, which may be sexually explicit, that is furnished by third-party users. All portions of the website that display such user-provided content are under the control of the relevant users. Therefore, the website operators and owners are absolved from compliance with Section 2257 records keeping and labeling obligations as given in 28 C.F.R. §75.1(c)(4). Any content that is believed to be illegal, obscene, harmful, harassing, defamatory or in any way antithetical to the terms of use and policies of the website, may be removed at the sole discretion of the operator or owner, in keeping with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

The visual depictions displayed on the website are exempt from the provision of 18 U.S.C. §§2257, 2257A and/or 28 C.F.R. §75, because: 1) they do not portray acts as specifically listed in 18 U.S.C §2256 (2)(A) (i) through (iv); 2) they do not portray acts as specifically listed in 18 U.S.C. §2257A produced after March 19, 2009; 3) they do not portray acts listed in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009; 4) the visual depictions were created prior to July 3, 1995.
